Supreme Court of India Rejected Petitions for NEET UG Re-Test and Result Cancellation

The Supreme Court of India on Monday quashed petitions seeking a re-test for the NEET UG exam and the annulment of the results announced on 4 June 2024 which means that the NEET UG 2024 results will not be cancelled and also NEET UG 2024 will not be re-conducted.

The decision is a setback for those aspirants who were demanding for re-test of NEET UG 2024 and cancellation of the NEET UG 2024 result. While the decision is a huge sigh of relief for the National Testing Agency. Now the NEET UG 2024 results will not be cancelled and also there will be no re-test of NEET UG 2024

The court concluded that there was no substantial evidence to suggest a widespread leak of the question paper that would compromise the exam’s integrity. Chief Justice of India DY Chandrachud, delivering the verdict, stated, “At the present stage, there is an absence of materials on record to show results of the exam were vitiated or there was a systemic breach in the conduct of the exam.”

Earlier in the day, the CBI presented its findings to the Supreme Court, revealing that the NEET UG question paper was leaked on the exam day, May 5. The leak originated in Hazaribagh and was subsequently transmitted to Patna.

Solicitor General Tushar Mehta presented center-wise data to demonstrate that there is no significant increase in the number of candidates securing medical admissions compared to previous years. He also noted that there are no inconsistencies in the results from Hazaribagh and Patna, the two cities under scrutiny for the alleged paper leaks.

In response to concerns about an ambiguous Physics question for which the National Testing Agency (NTA) provided two correct answers, Chief Justice Chandrachud directed IIT Delhi to provide an expert opinion. This issue resulted in many candidates receiving grace marks.

The Physics question is particularly important because 44 top scorers in the NEET UG exam received grace marks due to this ambiguity. Any decision regarding this question could potentially alter NEET ranks and impact the scores of thousands of students.

The CJI sought IIT Delhi’s expertise on the controversial Physics question in the NEET UG paper that led to the awarding of grace marks. Counsels for the petitioners argued that a re-test should be ordered, at least for the qualified candidates. Senior Advocate Hooda contended that there was a systemic failure in the conduct of NEET UG, in addition to the paper leak.

The NTA recently published city and center-wise results of NEET UG, which indicated that candidates who allegedly benefited from the paper leak and other irregularities did not perform well in the test. However, certain centers showed a high concentration of top scorers.

Over 23 lakh students appeared for NEET UG on May 5 at 4,750 centers across 571 cities, including 14 international cities. The counseling process for undergraduate medical admissions is expected to commence on July 24.
